Rent Mine Online Inc., operating under the web address of www.rentmineonline.com, (hereinafter: “RMO”) is a Delaware corporation, registered in the State of Delaware. 

Definitions

In these terms and conditions we use the following definitions:

-       “Users” means Owners, Hirers, Renters and any other visitors of the RMO website

-       “You” means User(s)

-       “We”, “us” and “our” are references to RMO

-       "The RMO Website" means content, software, facilities and services available within the domain and sub-domains of www.rentmineonline.com      

Membership

RMO Website use is restricted through membership. Users under 18 years old can use the RMO website only under the supervision of a parent or guardian. If you are registering as a business or organization, you must have the authority to bind that business or organization to this agreement.

You agree to use every effort to keep your Password safe and not to disclose it to any other person. You agree not to create more than one account that will access the site. You are responsible for your Usership account and all trades, interactions, dialogues and other actions using that account. You shall not transfer or sell your account to anyone. You shall also not permit, either directly or indirectly, any other person to use your Username or Password.

Use

RMO is not an intermediary in any hire agreements. The RMO website is simply a place which allows registered users to interact and trade. RMO does not hire or own the items listed. Users own the equipment they hire to other Users and the contractual hire agreement rests between them. RMO does not hold any responsibility for any aspect of any hire agreement made by use of this site including but not limited to delivery, price, quality, safety, or terms. You agree to use the RMO website in good faith with the intention of lawfully entering into hire agreements.

RMO does not endorse any item listed as being as described and has no control over the quality, safety or other aspect of the item. RMO takes no responsibility for ensuring that any hire agreements made conclude as intended, nor for legal infringements that hire agreements may incur. You accept sole responsibility for the legality of your actions under laws applying to you. You accept sole responsibility for having the necessary legal permits (e.g. driver’s license), required by local laws for the use of hired items. Certain items may have rental restrictions on them and you must check the legality of potential rental contracts before offering such items. 

In circumstances where insufficient detail can be presented in a listing then other sources of information can be referenced provided the user is encouraged to return to the RMO website to enter a rental agreement. .

Users agree to :

Only offer items for hire that they own, that they are legally entitled to hire

• To ensure the safety of other Users
• Not to misrepresent the availability, quality, function, or other description of items offered.
• Act lawfully and responsibly towards Hirers of their items

You are responsible for checking such information and for your actions arising from such information. You agree that charges are made for the information supplied, whatever its validity, accuracy or usefulness. RMO shall not be liable for any inaccuracies, deletions, omissions, or errors in the information within the RMO website. RMO is not responsible for any virus transmitted by you or third parties using the RMO website.

You agree not to submit any information that:

• Is contaminated or contains corrupted material or intends to cause damage or corruption (such as a virus).
• Intends to adversely affect the performance or availability of the service to other users.
• Is not specifically for the purposes of entering into hire agreements with other Users through the use of the RMO website.
• Offers services that are illegal or may causes offence to others.
• Is untrue, misleading, or could be readily misinterpreted as such.
• Is vulgar, obscene, racially, ethnically, or religiously objectionable.
• Is abusive, threatening, or damaging to any individual, company or organization.

In using RMO you agree that RMO may use any information supplied for the purposes of achieving rental agreements between owners and hirers. You also agree that RMO may amend, correct, adjust, translate, publish and distribute such information in whole or in part, and without consideration or compensation. RMO reserves the right to charge fees in the future for listing items or commissions based on successful transactions. Any information or content the user provides to RMO grants RMO a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to exercise the copyright, publicity and database rights of the content in any media known now or in the future.

Where you willingly provide information on your experience of another User you agree to do so fairly and justifiably. You agree that RMO can record, use, and display ratings describing others' experience of you or your Company's performance, or general description. You also agree that such ratings can be constructed in whole or part, by reference to third party experience of you, whether subjective or objective.

Liability

RMO provides a register and a venue to hiring; you deal directly with other Users: We provide an on line venue and mechanism to allow you to create a register of your resources, keep track of the resources, and contribute to and participate in an on line community of individuals and organizations who wish to hire resources. RMO does not take any part in the transactions other than by providing our website as a venue for Users. If you and another party agree to hire resources, then you and that other party must do so by agreement between yourselves. We do not act as agent for either party and do not participate in any transaction between you and other Users. The terms and conditions of any arrangement between you and another person or User are exclusively and entirely part of your arrangement with another party that you are transacting with.

You lend, borrow or hire at your own risk. Transactions between you and other Users are conducted entirely at your own risk. You agree that we take no responsibility or liability for any misconduct of any of our Users including, without limitation, Users that have registered under false pretences or who attempt to defraud you. We give no undertakings, representations, or warranties in relation to resources hired on the website. If you have a dispute with one or more users, you release RMO and all of its related constituents from claims, demands and damages of every kind and nature, known and unknown, arising out of ro in any way connected with such disputes.

If we have advertisements on the website, we are not responsible for the actions of the advertisers: Each advertiser is solely responsible for the content of and any representation made in connection with its advertisement. The placement of such advertisements on the website does not constitute our recommendation or endorsement of the advertised product or service. RMO excludes all liability. You expressly understand and agree that your use of our services is at your sole risk. You agree that, to the maximum extent permitted by law, any and all liability and responsibility of us to you or any other person under or in connection with these terms and conditions, or in connection with our services, this website, another User's acts or omissions, or your use of or inability to use, our services or this website is excluded regardless of whether such liability arises in contract, tort, breach of statutory duties or otherwise. Our liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, but not limited to, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.

You agree to make good any loss if your actions cause us any damage. You agree to release, indemnify and keep indemnified RMO from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us arising out of or in connection with your failure to comply with these terms and conditions, your failure to make available a hired resource or failure to perform a hired service as agreed with another User, your failure to return a hired resource, your hiring or attempted hiring of a resource listed on the prohibited items list, loss or damage of a resource, provision of a resource that is not of reasonable quality or is not fit for its purpose or arising out of any content or resource you submit, post, transmit, or make available through our services.

Ownership

You may not re-use, make copies of, distribute, re-sell, reproduce, nor publish, all or any part of the RMO website or the information contained within the RMO website without the express written permission of RMO.  

RMO is the owner of all intellectual property rights (including but not limited to designs, copyrights, intellectual processes, software, and know-how), other than the licensed re-use of proprietary software within the RMO website. Nothing in these terms shall be taken as granting you, or any third party, use of such intellectual property. 

Service Level

You agree that RMO may, at its own discretion, remove your access to the RMO Website. RMO does not guarantee continuous, uninterrupted access to RMO Website. You agree that RMO Website is provided "as is" and as and when available. You also agree that to the legal extent permissible RMO excludes all implied warranties, terms and conditions, including without limitation any terms as to performance or quality.

Insurance

RMO may provide access to insurance. If it is available, you may purchase insurance when you lend or hire out a resource to someone or when you borrow or hire in a resource. If insurance is not available, you are fully responsible for arranging any insurance you consider necessary. You may, as a term of lending or hiring, require the borrower or hirer to purchase insurance for your resource. You and the other party should agree which one of you is responsible for purchasing insurance and who is responsible for any claim excess and other costs that may arise prior  to exchanging possession of the resource. RMO is not party to any insurance policy: Whether arranged through the website or otherwise, any contract of insurance is between you and the named provider. We are not party to any contract of insurance.

Limitation

You agree that any claim or cause of action arising out of or related to use of RMO or its service or this agreement must be filed within one year after such claim or cause of action arose, or for forever be barred.

Void where prohibited

Although RMO can be viewed throughout the world, its use is prohibited in those countries under the laws of which any aspect of the RMO service will be illegal.

Severability

If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

General

You consent that RMO can amend these terms and conditions whenever RMO deems necessary to do so and that your use of RMO Website is against the terms prevailing at the time. Your use of the site is indication of acceptance of these terms and conditions.

Law and Jurisdiction

In the event that the User and RMO dispute the validity of these terms and conditions or the meaning, interpretation or operation of any term, condition, definition or provision of these terms and conditions, the User and RMO agree that the law of the state Delaware apply and that all litigation shall take place before the competent court in the State of Delaware. .
